Terms of Use

Welcome to Mooncake. These Terms of Use form an agreement between you and Mooncake LLC, a company registered in the United States, which operates the Mooncake dating app and this website. By creating an account or using Mooncake you agree to these terms, so please read them carefully. If you do not agree to them, please do not use Mooncake.

Age Requirement: You must be at least 18 years old to use Mooncake. By creating an account you confirm that you are 18 or older and that you have the legal capacity to enter into this agreement. We ask for your date of birth during onboarding and will remove any account we find to belong to someone under 18.

Your Account: Mooncake accounts are passwordless: you sign in either with Sign in with Apple or with a one-time code sent to your email address. You are responsible for keeping access to that Apple Account or email address secure, and for everything that happens under your account. You must give accurate information — including your real name, your real age and photos that are genuinely of you — and keep it up to date. You may hold only one account, and you may not share, sell or transfer it.

User Conduct: You agree to use Mooncake respectfully and lawfully. You may not post content that is illegal, harmful, abusive, harassing, defamatory, or that violates anyone else's rights. You may not impersonate another person, misrepresent your age, use someone else's photos, send spam or solicit money from other members, or attempt to disrupt the app or its other users. We may remove content and suspend or terminate accounts that breach these terms.

Zero Tolerance for Objectionable Content and Abusive Behaviour: Mooncake has zero tolerance for objectionable content and for abusive users. Content that is pornographic or sexually explicit, violent, hateful or discriminatory, harassing or threatening, deceptive or fraudulent, or that depicts, sexualises or solicits anyone under 18, is prohibited and will be removed. We automatically filter profile text and chat messages for objectionable content, and every report is read by a member of our team. You can report any member from their profile or from your chat with them, choosing a reason such as inappropriate photos, harassment, spam, appears underage, or fake profile. You can also block any member instantly, which immediately removes them from your shortlist and stops them contacting you; blocked members can be managed in the Profile tab. We aim to review every report and act on it within 24 hours, and we remove offending content and permanently terminate the accounts of members who violate this section, without refund and without notice. Content and Intellectual Property: You keep ownership of the content you post. You grant Mooncake a non-exclusive, worldwide licence to host, store, display and distribute that content only as far as is necessary to operate the service — for example, showing your profile to the members we shortlist it to. This licence ends when you delete the content or your account, subject to the retention period in our Privacy Policy. You confirm that you own or have permission to use everything you post, and that your photos are of you. All Mooncake features, design and branding remain ours and are protected by intellectual property laws.

Payments and Premium Features: Mooncake is currently free to use. We may introduce paid memberships or premium features in a future release. Any purchase you make inside the Mooncake iOS app is processed by Apple using In-App Purchase, billed to your Apple Account and managed in your Apple subscription settings, subject to Apple's terms. The price, billing period and cancellation terms will always be shown to you before you confirm a purchase, and you can cancel a subscription at any time in your Apple Account settings.

Account Termination: You may delete your account at any time from the Profile tab in the app. Deletion takes effect immediately and permanently: your account and profile are removed straight away and cannot be restored, so please be sure before you confirm. We may suspend or terminate your account if you breach these terms, and we will do so immediately and permanently for breaches of the zero tolerance section above. Our Privacy Policy explains what happens to your data when your account is deleted, and the limited safety and legal records we keep afterwards.

Disclaimers, Safety and Limitations: Mooncake is provided 'as is' and without warranties. We curate and review profiles, but we do not run criminal background checks on members and we cannot verify everything anyone tells us. We are not responsible for the conduct of any member, online or in person. You are responsible for your own safety: take the usual precautions when meeting someone new, meet in public the first time, tell someone where you are going, and never send money to another member. To the fullest extent permitted by law, we are not liable for any damages arising from your use of Mooncake or from your interactions with other members.

Governing Law: These terms are governed by the laws of the State of Wyoming, United States, and any disputes will be resolved in the courts of Wyoming. If you are a consumer in the EU or UK, you keep the rights and protections granted to you by the mandatory consumer law of the country you live in.

Changes to These Terms: We may update these terms from time to time. We will notify you of material changes by email or in the app before they take effect. If you continue to use Mooncake after that, you accept the updated terms; if you do not agree to them, you can delete your account.
